Can you return a pre-owned designer item in the UK?

Short answer

It depends who sold it. From a business you get the Consumer Rights Act 2015 and, buying at distance, 14 days to cancel for any reason. From a private individual you get far less: essentially that the item must be as described, with no right to change your mind. On eBay, the Money Back Guarantee applies to both.

The line that decides everything: trader or private seller

UK consumer law hangs on this distinction. A 'trader' is someone acting for purposes relating to their trade, business, craft or profession; a 'consumer' is an individual acting wholly or mainly outside theirs. If the seller is a trader, the Consumer Rights Act 2015 applies. If they are a private individual selling their own handbag, it does not.

Usefully, the burden of proof sits with the trader: if there is a dispute about whether you were acting as a consumer, it is for them to show you were not.

Buying from a business

Goods must be of satisfactory quality — the standard a reasonable person would consider satisfactory, taking account of the description, the price and all other relevant circumstances. That covers fitness for purpose, appearance and finish, freedom from minor defects, safety and durability.

Second-hand goods are covered, but judged on their own terms: as Business Companion (the Chartered Trading Standards Institute-backed guidance service) puts it, the same rights apply to seconds and sale goods, and price, age and easily identifiable defects are taken into account when deciding what quality is satisfactory.

The important exclusion for resale: the Act does not bite on defects that were specifically drawn to your attention before you bought, or that your own examination of the item ought to have revealed. A flaw disclosed in the listing is not a breach — which is why disclosure, not condition, is the thing to read for.

The 14-day right to cancel

Under the Consumer Contracts Regulations 2013 you may cancel a distance contract at any time in the cancellation period without giving any reason and without liability. For goods, that period ends 14 days after the day the item comes into your physical possession. You then have a further 14 days to send it back.

This applies to traders only. There is no equivalent right against a private seller, and gov.uk states the position from the trader's side plainly: a refund is not owed simply because a customer no longer wants an item — unless they bought it without seeing it, which is exactly what a distance sale is.

Buying from a private individual

The quality and fitness terms in the Consumer Rights Act apply to trader contracts. From a private seller, the goods need only be as described. There is no satisfactory-quality standard, no right to cancel, and no right to return because you have changed your mind.

'As described' is not nothing, though. If a listing said full set and it arrived without papers, or said no damage and it has a scuff, that is a misdescription and there is a route to a remedy — on a marketplace, usually a faster one than the courts.

What eBay adds on top

The eBay Money Back Guarantee is a platform remedy, and it applies to purchases from private sellers too — which in practice often makes it stronger than your statutory position against that seller.

It covers items that do not arrive, arrive damaged or faulty, do not match the listing, or where the seller will not honour their own returns policy. Non-arrival must be reported within 30 calendar days of the estimated delivery date. Not-as-described and faulty claims run for 30 calendar days after the estimated or actual delivery date, or the seller's stated window if it is longer.

The clock then keeps running: the seller has three business days to respond, and you can ask eBay to step in for up to 21 business days after the report date.
